Other Dog Laws

On this page, you will find various other dog laws that the Holmes County Dog Warden’s Department is responsible for enforcing. Although violations of these laws may not occur as frequently as other Dog laws, the Holmes Count Dog Warden’s Department will not hesitate to enforce them. These laws include Dog Quarantines, Dogs Wearing False Tags, and requiring registered dogs to wear their tags.

Statute: O.R.C 955.261 Duties after dog bites person

It is important to understand that when your dog or a dog has bitten someone in Holmes County it must be immediately put under a 10 day rabies quarantine by law. The dog cannot be shipped out of the county in which the bite occurred and cannot be killed unless the killing of the dog is required to prevent further injury. If the dog is killed, immediately after being killed, the head must be submitted to the Holmes County Health Department for rabies testing. If a dog is killed and not submitted for testing and/or shipped out of county this will be considered a violation of the dog owner’s duties and the dog owner, keeper, or harborer will be subject to citation.

Quarantine Restrictions: During the quarantine, the owner, keeper, or harborer of any dog shall keep it confined on the premises of the owner, keeper, or harborer, or in a pound, kennel, or other suitable place, at the expense of the owner, keeper, or harborer, except that a dog may be permitted to leave the premises of its owner, keeper, or harborer if it is under leash or under the control of a responsible person. The quarantine order shall be considered an emergency and need not be published.

Penalties: Any Violation of Ohio Revised Code 955.261 is a minor misdemeanor on a first offense and a misdemeanor of the fourth degree on each subsequent offense.

Statute: O.R.C 955.25: Unlawful tag

No person shall own, keep, or harbor a dog wearing a fictitious, altered, or invalid registration tag or a registration tag not issued by the county auditor in connection with the registration of such animal.

Penalty: Minor Misdemeanor

Statute: O.R.C 955.10: Tags to be worn

No owner of a dog, except a dog constantly confined to a dog kennel registered under this chapter or one licensed under Chapter 956. of the Revised Code, shall fail to require the dog to wear, at all times, a valid tag issued in connection with a certificate of registration. A dog found not wearing at any time a valid tag shall be prima-facie evidence of lack of registration and shall subject any dog found not wearing such a tag to impounding, sale, or destruction.
